Sales conditions: valid for travel from Winter 2020-2021

1. PRICING AND PRODUCT

1.1 HOTEL

1.1.1 Half-board formula including:

a) the stay in a hotel room with meals foreseen in the programme;

b) the charge for the guarantee insurance;

c) the VAT according to the known tax rates; overnight stay and breakfast buffet and personal accident insurance (cf. ‘Personal injury insurance’).

1.1.2 The following are not included:

a) costs of travel passes, visas, vaccinations and other formalities;

b) drinks (unless otherwise mentioned);

c) personal expenses and tips;

d) any excursions that are not expressly mentioned as included;

e) any tourist taxes imposed by the authorities after the publication of the offer and that must be paid on site;

f) certain costs that must be paid on site, according to local custom (see the pricelist below);

g) transportation between the airport or station and the residence (to and from);

h) travel and assistance insurance;

i) cancellation insurance.

1.2 SKI LESSONS

Ski lessons can be followed with the local ski school and should be requested there.

1.3 INTERSOC PRICE GUARANTEE

If, after the pricelist is published, a promotional price should be given for a specific period that includes a discount on the published prices, all holiday guests that have already registered for this period will receive a voucher for a future holiday at an Intersoc hotel for the value of the price difference, as if they had booked the promotion. The voucher will be sent to them at the end of the period.

1.4 GENERAL

For the calculation of our participation fee, and the validity of our price promotions, we use the actual date of birth of the participant, or the year of birth (see pricelist). As a reference date, the first day of the holiday period is always taken.

Materials hired at the hotel, overnight stays and meals outside of the holiday village or hotel, optional sports activities and excursions, and all services not explicitly mentioned are not included in the price.

In the pricelist for each destination, the price of the stay (full board formula or rental formula) with personal transport is specified, plus any additional fees for transport, meals and other possible options.

The prices are guaranteed for the whole season, subject to any obvious material mistake or a price review in one of the circumstances described under Art. 6.3 of the ‘General Travel Conditions of the vzw Travel Dispute Commission’. Intersoc vzw does not accept any liability for situations in which weather conditions or local events should bring about the cancellation of certain services (e.g. strikes, queues, etc.).

All prices are stated in CHF.

2 PAYMENT

If you do not pay on time, vzw Intersoc can request the amount due plus a fixed administrative fee of 10 % and late payment interest of 8.5 % calculated from the time that the amount is due according to the above conditions.

3 CANCELLATION BY THE TRAVELLER

The cancellation conditions here below apply to a partial or full cancellation.

3.1 COMPLETE CANCELLATION

if the traveller cancels the travel contract, the following fees will apply:

3.1.1 Stay

• from registration until 45 days before departure: 30 euros per person;

• from 44 days to 31 days before departure: 30% of the travel price

• from 30 days to 8 days before departure: 60% of the travel price

• from 7 days to the day before departure: 90% of the travel price

• in the event of cancellation or absence on the first day of the holiday period: the total travel price

3.2 PARTIAL CANCELLATION

For any partial cancellation the above-mentioned fees will apply to the sale price of the cancelled part or option.

3.3 EARLY RETURN AND HOSPITALISATION

An early return from or a late arrival at the holiday destination can in no way lead to a demand for reimbursement or any other right. In the same way, for days spent in hospital or in the case of death, there is no reimbursement for the unused days of the holiday.

3.4 ADDITIONAL PROVISIONS

In no case can the amounts paid be transferred to another file. The date of receipt of the cancellation will be used to determine the date of cancellation. Cancellations by phone will not be accepted. Only cancellations made within the last eight days before the departure date must first be communicated by phone to the Intersoc vzw Brussels Customer Services, but this must also be confirmed in writing.

4 CANCELLATION BY THE TRAVEL ORGANISER

4.1 NON-PERFORMANCE OF THE TRAVEL CONTRACT

At the latest one month before the departure, we offer the traveller a choice between a fair alternative or the possibility of cancelling the participation without cancellation fees. In the event of force majeure (strike, weather conditions, etc.) an alternative will be proposed but in this case the cancellation fees will not be reimbursed.

4.2 SPECIFIC PROVISIONS FOR FORCE MAJEURE

4.2.1 Shortage of snow

Alternatives in the case of a shortage of snow: if there is a shortage of snow in the area for which the ski pass is valid, we will search for more certain snow areas in the region. The transport costs and/or the possible surcharge for the ski pass will be at the expense of the guests. The original cost of the ski pass will not be reimbursed.

5 PERSONAL ACCIDENT INSURANCE

In the event of an accident with bodily injury you are insured from the time of departure with transport organised by Intersoc until the return of this transport to Belgium.

Car travellers are insured during their stay in the holiday destination, as well as in the stopover hotel booked via Intersoc vzw, not during the use of your own vehicle, both on the journey from home to holiday destination and at the holiday destination. 5.1 INTERSOC INSURANCE COVERS:

Insurance amounts:

› Person from 5 years old up to and including 70 years old: 9,915.74 euros in the event of death and 14,873.61 euros in the event of 100% permanent work incapacity.

› Adults above 70 years old: 4,957.87 euros in the event of death and 7,436.80 euros in the event of 100% permanent work incapacity.

› Child under 5 years old: 2,478.94 euros in the event of death and 29,747.22 euros in the event of 100% permanent work incapacity. Travel costs by ambulance, in Belgium, from the train or the bus to the hospital or the home are covered. All further transport costs are at the expense of the patient. The aftercare costs in Belgium are covered by the insurance. After you have paid the costs, the ‘Mutuelle’ will reimburse the health insurance intervention.

The maximum intervention of the Intersoc insurance in the medical costs (care received abroad and after-care) amounts to 2,478.94 euros, after exhaustion of the ‘Mutuelle’ interventions, and with the exception of an excess charge of 124 euros per accident for the aftercare in Belgium. In the case of hospitalisation, only the medical costs will be reimbursed. Supplemental costs for a private room and the increased fees resulting from this, such as telephone, TV, drinks, etc. are at the expense of the patient.

5.2 THE INTERSOC INSURANCE DOES NOT COVER:

› Bodily injury through the use of a personal vehicle or means of transport that is not included in the Intersoc vzw programme. This is subject to the rules of the European Health Insurance Card;

› Costs of care in the case of aggravation of an illness or an early return home that is the result of an accident originating from a pre-existing condition such as, among others, epilepsy, heart disease and diabetes;

› Damage to, loss or theft of personal effects such as luggage, glasses, watches, car, etc., neither at the holiday destination nor during the journey;

› Personal third-party liability;

› Replacement and repair of dental prostheses;

› Dental care, except in acute emergency situations, and after positive opinion of the hotel doctor or local physician;

› Temporary work incapacity and loss of earnings;

› Sports activities that were not offered by the hotel or the holiday village and were not accompanied by monitors;

› Ski activities that take place away from the marked pistes and are not in line with the guidelines of the ski area;

› Search costs (e.g. helicopter) for lost guests; transport costs from the place of an accident to the hospital are insured. If the conditions described are not sufficient for you, you can go directly to an insurer of your choice for a suitable omnium, car and/or luggage travel insurance. N.B. we advise our holiday guests, in the context of the CM travel insurance (health and accident), to take the World Assistance Card

6 GENERAL RESERVATIONS

All photos and information included in our publications, were collected in good faith and presented as honestly as possible, based on the information that was available at the time of putting together the publication. The responsibility of Intersoc vzw goes no further than this. In the case of demonstrable errors, incomplete information and mistakes Intersoc vzw is prepared to investigate these shortcomings and to propose a satisfactory solution. By registering for a certain period and destination, mentioned in this brochure, the Intersoc guest acknowledges that he has taken note of the practical information and the sales conditions and that he agrees to them.

7 PRIVACY LAW

The information mentioned on the registration form is intended for the internal use of Intersoc vzw and its employees, by means of data processing. It may also be transferred to an organisation linked contractually with Intersoc vzw. As an interested party your name and address details are recorded in our customer file. The holder and processor of the file is the vzw Intersoc, with offices located at Haachtsesteenweg 579 in 1031 Brussels. In accordance with the law of 8 December 1992 you have a right of access and a right to rectification.

Intersoc vzw reserves the right to use photos taken or collected by itself in its holiday destinations for the purposes of its own publicity. In the event of opposition, at the request of the customer, and taking into account a reasonable delay, Intersoc vzw will no longer use these photos in their publications.

8 INSOLVENCY

In order to offer the holiday guests as much security as possible, Intersoc vzw, in accordance with art. 36 of the law of 16 February 1994 and the relevant implementing decision of van 25 April 1997, has subscribed to an insurance policy with the insurance company ‘De Volksverzekering’, who will intervene if the execution or the continuation of the holiday should be compromised by the financial insolvency of the travel organiser.

9 COMPLAINT HANDLING

Intersoc vzw subscribes to the complaint handling foreseen in Art. 16 of the  ‘Travel Conditions of the Travel Dispute Commission’. If a complaint is not resolved on site or if it is impossible for you to make a complaint during the trip, please address this complaint in writing to:

Intersoc vzw applies the travel conditions of the Travel Dispute Commission.
